2. ASSUMPTION OF RISK & LIABILITY WAIVER

BY PURCHASING AND USING OUR PRODUCTS, YOU ASSUME ALL RISK of any adverse reactions, allergic responses, or health consequences. You waive all medical claims against Elaria Beauty.

You are solely responsible for:

• Determining product suitability for your health and skin type
• Consulting healthcare providers before use
• Conducting patch tests on topical products
• Any adverse reactions or health outcomes

3. LIABILITY CAP & EXCLUSIONS

ELARIA BEAUTY'S TOTAL LIABILITY IS LIMITED TO $100 USD OR THE AMOUNT YOU PAID, WHICHEVER IS LOWER.

We are NOT liable for any:

• Indirect, incidental, special, or consequential damages
• Lost profits, lost revenue, or lost business opportunity
• Personal injury, bodily harm, or health complications
• Allergic reactions or adverse skin conditions
• Product performance or results

4. BINDING ARBITRATION & NO CLASS ACTION

ANY DISPUTE ARISING FROM YOUR USE OF THIS SITE OR PURCHASE OF PRODUCTS SHALL BE RESOLVED BY BINDING ARBITRATION, NOT LITIGATION.

YOU WAIVE YOUR RIGHT TO:

• Sue in court or file a lawsuit
• Participate in class action lawsuits
• Pursue any claim on a class-wide basis
• Jury trial

All disputes are individual arbitration only under JAMS rules. The arbitrator's decision is final and binding.

5. INDEMNIFICATION

You agree to indemnify and hold harmless Elaria Beauty from any claims, damages, losses, or legal costs arising from:

• Your use or misuse of products
• Your violation of these Terms
• Any bodily injury or health consequences from product use
• Any third-party claims related to your purchase or use

6. DISCLAIMERS & "AS-IS"

PRODUCTS ARE SOLD "AS-IS" WITHOUT ANY WARRANTIES.

We disclaim:

• Any warranty of merchantability
• Any warranty of fitness for a particular purpose
• Any warranty that products will produce specific results
• Any warranty against adverse reactions

7. NO REFUNDS FOR RESULTS

Refunds are NOT available because products did not produce expected results. Results vary by individual. This is not a basis for return.

8. CHARGEBACK WAIVER

You waive the right to dispute charges with your payment provider. Filing a chargeback while a refund is pending will result in:

• Immediate account termination
• Permanent refund ineligibility
• Account blacklisting

9. GOVERNING LAW

These Terms are governed by Delaware law. You consent to exclusive jurisdiction in Delaware courts.

10. PAYMENT & FRAUD

You authorize us to charge your payment method. If we detect fraudulent activity, we may cancel orders, refund payments, and report to law enforcement.

11. MODIFICATION & SEVERABILITY

We reserve the right to modify these Terms at any time. Your continued use constitutes acceptance. If any provision is unenforceable, the remainder stays in effect.
